Terms of service
Terms of Service
Overview
This website is operated by Second Spring. Throughout the Site, the terms “we,” “us,” and “our” refer to Second Spring. We offer this website, including all information, tools, products, and services available through it, subject to your acceptance of these terms, conditions, policies, and notices.
By visiting our website or purchasing from us, you engage with our “Services” and agree to these Terms of Service and Sale (“Terms”), including the policies and additional terms referenced here. These Terms apply to all users of the Site, including visitors, customers, vendors, merchants, and contributors of content.
Please read these Terms carefully before accessing or using the Site. If you do not agree to these Terms, you may not use the Site or Services.
New features and tools are also subject to these Terms. We may update these Terms by posting a revised version on the Site and providing any notice required by applicable law. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. Changes will not retroactively alter completed purchases except as permitted by applicable law.
Our store is hosted on Shopify Inc., which provides the ecommerce platform we use to offer our products and Services.
Section 1 — Online Store Terms
By agreeing to these Terms, you represent that you are at least the age of majority in your place of residence or have provided permission for your minor dependents to use the Site under your supervision. Purchases are subject to the age requirements in Section 19.
You may not use our products or Services for illegal or unauthorized purposes or violate applicable laws when using them. You must not transmit viruses, worms, malware, or other destructive code.
A violation of these Terms may result in suspension or termination of your access to the Services.
Section 2 — General Conditions
We reserve the right to refuse service to any person, subject to applicable law.
You understand that content, excluding payment card information, may be transferred across networks and adapted to technical requirements. Payment card information is encrypted during transmission.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services, access to the Services, or content on the Site without our written permission.
Section 3 — Accuracy, Completeness, and Timeliness of Information
Information on the Site is provided for general informational purposes. Although we aim to provide accurate information, it may occasionally be incomplete, inaccurate, or outdated.
You should not rely exclusively on general website content when making decisions. Historical information is provided for reference and may not be current. We may update the Site at any time but are not obligated to update every item of information unless required by law.
Section 4 — Changes to Services and Pricing
Product prices may change. Pricing for purchases and subscriptions is subject to Section 19 and any disclosures provided at checkout.
We may modify, suspend, or discontinue any part of the Services. To the extent permitted by law, we are not liable for modifications, price changes, suspensions, or discontinuation.
Section 5 — Products and Services
Certain products may be available exclusively online and in limited quantities. Refund eligibility is governed by our Refund Policy and the 60-Day Money-Back Guarantee described in Section 19.7. Product returns are not required and are not accepted under that guarantee.
We make reasonable efforts to display product images and colors accurately, but we cannot guarantee that your screen will display them exactly.
We may limit sales by person, location, or jurisdiction; limit quantities; discontinue products; and refuse orders, subject to applicable law. Product descriptions and availability may change.
Section 6 — Billing and Account Information
We reserve the right to refuse, limit, or cancel orders, including orders associated with the same customer account, payment card, billing address, or shipping address. Where appropriate, we will attempt to notify you using the contact information provided with your order.
You agree to provide complete and accurate account, contact, and payment information and to update it promptly so we can process transactions and contact you when necessary.
Section 7 — Optional Third-Party Tools
We may provide access to third-party tools that we do not monitor or control. These tools are provided “as is” and “as available,” without endorsement or additional warranties from us, to the extent permitted by law.
Your use of optional third-party tools is at your own discretion and subject to the relevant provider’s terms. Future features and tools offered through the Site are also subject to these Terms.
Section 8 — Customer Support SMS Program
Second Spring’s customer support SMS program is separate from promotional messaging. Where offered, customers may opt in through a designated support messaging channel or another consent mechanism presented during a support interaction.
Customer support messages are used for service and transactional purposes, including order updates, billing support, subscription inquiries, and account assistance. Providing a phone number alone does not constitute consent to promotional text messages.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. You can also email support@trysecondspring.co.
SMS opt-in data and consent records will not be shared with third parties except service providers as necessary to operate the messaging program. Mobile phone contact information will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.
Section 8A — Third-Party Links
The Site may contain third-party content or links to third-party websites. We do not control these websites and are not responsible for their content, accuracy, privacy practices, or products.
Review the relevant third party’s policies before making a transaction. Questions or complaints about third-party products or services should be directed to that provider.
Section 9 — Comments, Feedback, and Other Submissions
If you submit reviews, comments, ideas, suggestions, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, translate, and distribute that content in connection with our business, subject to applicable law and our Privacy Policy.
We are not obligated to keep unsolicited submissions confidential, compensate you for them, or respond to them unless we separately agree otherwise.
You are responsible for your submissions. They must not infringe another person’s rights, contain unlawful or abusive material, impersonate another person, misrepresent their source, or include malware.
We may monitor, edit, or remove content that violates these Terms or applicable law.
Section 10 — Personal Information
The collection and use of personal information through the Site are governed by our Privacy Policy.
Section 11 — Errors, Inaccuracies, and Omissions
Information on the Site may occasionally contain errors relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.
Subject to applicable law, we may correct errors, update information, or cancel orders affected by inaccurate information. If we cancel a paid order, we will refund the amount charged for that order.
We are not obligated to update information except as required by law.
Section 12 — Prohibited Uses
You may not use the Site or its content to:
- Engage in unlawful activities or encourage others to do so.
- Violate applicable laws or regulations.
- Infringe intellectual property or other rights.
- Harass, abuse, threaten, defame, or unlawfully discriminate against others.
- Submit false or misleading information.
- Upload malware or other harmful code.
- Collect or track other people’s personal information without authorization.
- Send spam, phish, or conduct unauthorized scraping or crawling.
- Distribute unlawful obscene material.
- Interfere with or circumvent security features.
We may suspend or terminate access for prohibited uses.
Section 13 — Disclaimer of Warranties and Limitation of Liability
We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.
Except for express commitments, including our 60-Day Money-Back Guarantee, and rights that cannot be excluded by law, the Site, products, and Services are provided “as is” and “as available.”
The detailed warranty disclaimers and liability limitations in Sections 19.9 and 19.10 apply to purchases and related claims.
Section 14 — Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Second Spring and its affiliates, officers, directors, employees, agents, contractors, suppliers, and service providers from third-party claims, liabilities, damages, and reasonable expenses arising from your breach of these Terms or violation of applicable law or another person’s rights.
Section 15 — Severability
If a provision of these Terms is found unlawful, invalid, or unenforceable, it will be severed to the extent necessary, and the remaining provisions will continue in effect.
Section 16 — Termination
These Terms remain effective until terminated. You may stop using the Site at any time and contact us to request account closure.
Stopping use of the Site or closing an account does not automatically cancel a subscription. Subscriptions must be canceled as described in Section 19.5 and our Cancellation Policy.
We may suspend or terminate access if you violate these Terms. Obligations incurred before termination and provisions intended to survive termination will remain effective.
Section 17 — Entire Agreement
These Terms and the policies incorporated into them constitute the agreement governing your use of the Site and Services. For purchases, the order confirmation and Terms of Sale below also apply.
Our failure to enforce a provision does not waive our right to enforce it later.
Section 18 — Governing Law and Priority
The governing-law provisions in Section 19.14 apply to these Terms, subject to mandatory rights under applicable law.
If there is a conflict concerning purchases, subscriptions, payments, delivery, refunds, or related disputes, the Terms of Sale in Section 19 control, subject to applicable law.
Section 19 — Terms of Sale
PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS IMPORTANT TERMS ABOUT PURCHASES, SUBSCRIPTIONS, REFUNDS, AND DISPUTES.
SECTION 19.15 PROVIDES FOR INDIVIDUAL BINDING ARBITRATION AND LIMITS COURT AND CLASS-ACTION RIGHTS, EXCEPT WHERE PROHIBITED BY LAW OR IF YOU TIMELY OPT OUT.
19.1 — Application and Eligibility
These Terms of Sale apply to purchases of products and services from Second Spring through the Site. By placing an order, you accept these Terms.
You may not purchase if you do not agree to these Terms, are younger than 18 or the legal age required to enter a binding contract where you live, whichever is greater, or are prohibited by applicable law from purchasing or using the products or Services.
Review the current Terms before ordering. Updates apply prospectively, subject to applicable law and any required notice.
19.2 — Order Acceptance and Cancellation
Your order is an offer to purchase the products or services listed in it. We may accept or decline an order, subject to applicable law.
A contract of sale is formed when we send your order confirmation email containing your order number and purchase details.
If you wish to cancel an order, contact support@trysecondspring.co promptly. Cancellation may not be possible after processing or shipment. Subscription cancellation and refund eligibility are addressed separately below.
19.3 — Product Information and No Medical Advice
Content on the Site is provided for general informational purposes and is not medical advice or a substitute for advice from a qualified healthcare professional. Consult your healthcare provider about whether a product is appropriate for you.
Unless expressly stated otherwise, statements about dietary supplement products have not been evaluated by the U.S. Food and Drug Administration. Such products are not intended to diagnose, treat, cure, or prevent any disease.
We do not guarantee particular health or wellness results. Individual results may vary based on factors such as age, health, genetics, and product use.
Product images and descriptions are intended to represent products accurately, but screen colors may vary. Historical information may not be current.
19.4 — Prices and Payment
The price charged for an order is the price disclosed when you place it and reflected in your order confirmation. Taxes, shipping, and handling charges, where applicable, are disclosed during checkout.
Prices may change for future purchases. Subscription price changes are subject to applicable notice and consent requirements.
By providing payment information, you represent that you are authorized to use the payment method, that the information is accurate, and that sufficient funds or credit are available. You are responsible for fees imposed by your bank or payment provider.
Where supported by your card issuer, our payment processors may receive updated card numbers or expiration dates to maintain payment continuity. Contact your card issuer for information about opting out of its account-updater service.
A reversed payment does not eliminate a valid payment obligation. We may seek payment through another lawful method, subject to your rights to dispute a charge.
19.5 — Subscriptions and Automatic Renewals
If you purchase a subscription, you authorize recurring charges to your selected payment method at the amount and frequency disclosed at checkout. Unless another cadence is selected, subscriptions are billed every 30 days.
Your subscription continues and renews automatically until canceled. To avoid the next recurring charge, you must cancel at least 24 hours before your next scheduled billing date.
You may cancel through the subscription-management portal, where available, or by emailing support@trysecondspring.co. Include your full name and order number so we can identify your subscription.
Cancellation stops future renewals and takes effect at the end of the current billing period. Requests received after the cancellation deadline may take effect for the following billing period. Cancellation does not automatically refund charges already processed.
Refund requests are governed by Section 19.7 and our Refund Policy. We may decline to renew a subscription, subject to applicable law.
19.6 — Shipping and Delivery
We arrange shipment using the delivery options available for your order. You are responsible for shipping and handling charges disclosed at checkout.
Shipping and delivery dates are estimates unless expressly guaranteed. To the extent permitted by applicable law, title and risk of loss pass when products are transferred to the carrier. Any mandatory consumer rights concerning delivery or loss remain unaffected.
If your shipment is delayed, lost, or damaged, contact support@trysecondspring.co for assistance.
19.7 — 60-Day Money-Back Guarantee
We offer a 60-Day Money-Back Guarantee under our Refund Policy:
- Refund requests must be submitted within 60 days of the confirmed delivery date.
- Requests submitted after that period are not eligible under the guarantee.
- Shipping and handling fees are non-refundable.
- Product returns are not required and are not accepted.
For subscriptions, the guarantee period begins on the confirmed delivery date of the initial subscription order. Renewals do not restart or extend it. Renewal charges processed after that period are not eligible under the guarantee.
To request a refund, email support@trysecondspring.co within the applicable period.
The guarantee does not limit any refund, replacement, or other rights that cannot be excluded under applicable law.
19.8 — Electronic Communications and Text Messages
You agree to receive account, order, and service communications electronically at the email address you provide or through the Site, where legally permitted. Electronic communications satisfy writing requirements to the extent allowed by law.
Where you separately opt in to an SMS program, you agree to receive the types of messages described when you consent. Marketing consent is not a condition of purchase.
Message frequency varies. Message and data rates may apply. Delivery depends on your carrier and network availability. Carriers are not responsible for delayed or undelivered messages.
We may disclose messaging information to service providers solely as necessary to deliver and administer the program, consistent with our Privacy Policy. We do not share SMS consent or mobile contact information with third parties for their own marketing.
Reply STOP to unsubscribe or HELP for assistance. You may also contact support@trysecondspring.co.
19.9 — Disclaimer of Warranties
EXCEPT FOR EXPRESS WARRANTIES OR COMMITMENTS WE PROVIDE, INCLUDING OUR 60-DAY MONEY-BACK GUARANTEE, AND EXCEPT WHERE PROHIBITED BY LAW, THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE FULLEST EXTENT PERMITTED BY LAW, SECOND SPRING DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Nothing in these Terms excludes warranties, conditions, guarantees, or remedies that cannot lawfully be excluded. Where applicable law limits a disclaimer, it applies only to the extent permitted.
19.10 — Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SECOND SPRING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE SITE, SERVICES, OR PRODUCTS.
THIS INCLUDES LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, AND COSTS OF SUBSTITUTE PRODUCTS OR SERVICES, WHETHER A CLAIM ARISES IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.
TO THE EXTENT PERMITTED BY LAW, SECOND SPRING’S TOTAL LIABILITY FOR CLAIMS ARISING FROM THESE TERMS, THE SITE, OR PURCHASES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID SECOND SPRING DURING THE PRECEDING 12 MONTHS OR US $100.
These limitations do not apply where prohibited by law. The limitations in this section do not apply to customers located in New Jersey. If a limitation is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
If you are dissatisfied with the Site, you may discontinue using it. This does not affect any remedies available under applicable law.
19.11 — Personal Use; Resale and Export
Products are sold for personal or household use and not for resale or export without our authorization. You agree to comply with applicable laws and regulations concerning the purchase and use of products.
19.12 — Privacy
Our Privacy Policy describes how we collect, use, and disclose personal information in connection with purchases and use of the Services.
19.13 — Events Beyond Our Reasonable Control
To the extent permitted by law, we are not responsible for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, fires, floods, war, terrorism, civil unrest, government action, epidemics, pandemics, labor disputes, carrier disruptions, supply shortages, telecommunications failures, or power outages.
This provision does not remove obligations or consumer remedies that cannot be excluded by law.
19.14 — Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration provision below.
Nothing in this section deprives you of mandatory consumer protections that apply under the laws of your place of residence.
19.15 — Dispute Resolution and Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS TO BRING A CLAIM IN COURT, HAVE A JURY TRIAL, OR PARTICIPATE IN A CLASS ACTION.
A. Agreement to Arbitrate
Except where prohibited by law or where you timely opt out, disputes arising from or relating to these Terms, our Privacy Policy, advertising, marketing, products, or Services will be resolved through final, binding, individual arbitration before a single arbitrator administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.
The arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16. To the extent permitted by law, the arbitrator will determine whether a dispute is subject to arbitration.
The arbitrator will apply applicable substantive law and may award remedies available in an individual lawsuit, including compensatory, statutory, or punitive damages, declaratory or injunctive relief, public injunctive relief where available, and attorneys’ fees and costs where authorized by law.
Arbitration proceedings will be confidential to the extent permitted by law and applicable rules, without restricting disclosures necessary to exercise legal rights or comply with legal obligations.
B. Individual Proceedings
To the extent permitted by law, claims must be brought individually. The arbitrator may not conduct class or representative proceedings or consolidate claims without Second Spring’s consent.
If a particular claim or remedy cannot lawfully be arbitrated, that claim or remedy may proceed in court while other arbitrable claims remain subject to arbitration, where permitted by law.
C. Intellectual Property Claims
Notwithstanding this arbitration agreement, Second Spring may seek injunctive or other equitable relief in state or federal courts in Florida concerning actual or threatened infringement or misappropriation of its intellectual property rights, to the extent permitted by law.
D. Rights Affected
Unless you timely opt out or applicable law provides otherwise, arbitration replaces the right to have covered disputes decided by a judge or jury. Discovery and appeal rights may be more limited than in court.
To the extent permitted by law, you waive participation in class or representative actions concerning covered disputes.
E. How to Opt Out
You may opt out of this arbitration agreement within 30 days of purchasing a product or service by emailing support@trysecondspring.co with the subject line “Arbitration Opt-Out.”
Include your full name, order number or product purchased, and a clear statement that you wish to opt out of arbitration. Timely opting out does not affect the remaining Terms.
19.16 — Assignment
You may not assign your rights or delegate your obligations under these Terms without our prior written consent, except where applicable law provides otherwise. An unauthorized assignment does not relieve you of your obligations.
19.17 — No Waiver
Our failure to enforce a right or provision does not waive future enforcement. A waiver is effective only if provided in writing by an authorized representative of Second Spring.
19.18 — No Third-Party Beneficiaries
These Terms do not create rights or remedies for third parties except where expressly stated or required by law.
19.19 — Notices
We may send notices to the email address you provide or post notices on the Site, as permitted by law. You are responsible for keeping your contact information current.
Send notices to Second Spring by emailing support@trysecondspring.co. Use a subject line that identifies the purpose of the notice and include sufficient information to identify your account or order.
Notices take effect in accordance with applicable law. Arbitration opt-outs must be sent within the deadline in Section 19.15.
19.20 — Severability
If a provision is held invalid or unenforceable, it will be severed or limited to the extent necessary, and the remaining provisions will remain in effect, subject to the arbitration-specific provisions above.
19.21 — SMS Program Terms
Participation in an SMS program is also subject to the disclosures presented when you opt in and the messaging provisions of these Terms and our Privacy Policy.
19.22 — Entire Agreement
These Terms, your order confirmation, and the policies incorporated by reference constitute the agreement between you and Second Spring concerning the relevant purchase and Services, subject to applicable law.
